My textbook says alleged rapists in NSW are charged with sexual assault and not rape. For details see Law Link. One may still say that a person is accused of rape, as best I understand it. Can anyone please let me know if indeed that is not the case. |

Correct, Paul. What had been the common law offence of rape was overhauled in 1981 (Crimes (Sexual Assault) Amendment Act) and again in 1989 (Crimes (Amendment) Act). Some other Australian states retain the rape charge. |
