NEW YORK - If a perfectionist like Martha Stewart were going to cook up a conspiracy (Hah! Get it?)
, her chief defense lawyer argued Tuesday, the result would never be as sloppy and inconsistent as the one the government alleges.
Robert G. Morvillo, in a three-hour closing statement in federal court, pointed to the ""major, gaping, huge holes'' in the alleged cover story of Stewart and her former stockbroker, Peter E. Bacanovic, to insist that the government's theory makes no sense.
The inconsistencies in the two defendants' recollections of Stewart's Dec. 27, 2001, sale of ImClone Systems Inc. stock and the events that followed point instead to innocent memory flaws - lapses that were blown out of proportion by a government ""overreaching'' to prosecute the celebrity entrepreneur, Morvillo argued.

NEW YORK - Jurors at the Martha Stewart stock trial finished a second day of deliberations Thursday after indicating they were focused on whether they had enough evidence to convict her former broker of perjury. Jurors also asked to examine the testimony of a Securities and Exchange Commission attorney who interviewed Peter Bacanovic, Stewart's broker and co-defendant, twice in 2002.
Bacanovic and the domestic-style mogul are accused of lying about her 2001 sale of ImClone Systems stock....

NEW YORK - Martha Stewart's fate is now in the hands of eight women and four men from New York City and its suburbs.
The jury got the criminal case against Stewart, 62, and her former broker Peter Bacanovic, 41, at about 11:45 a.m. Wednesday after hearing 1 1/2 hours of legal instructions from U.S. District Judge Miriam Goldman Cedarbaum.
""You will now have to decide where the truth lies,'' Cedarbaum said. ""You should use your common sense, good judgment and experience.''
The panel members had lunch with six alternate jurors before settling down to the task at hand and went home at 5 p.m. after making requests to see eight separate pieces of evidence ranging from Bacanovic's phone records to the transcript of testimony from government star witness Douglas Faneuil.
Stewart and Bacanovic are charged with conspiring, making false statements and obstructing a federal investigation into the domestic entrepreneur's Dec. 27, 2001, sale of ImClone Systems Inc.
